🚫 Prohibited Activities

In connection with your use of or access to the VYBZ services ("Services"), you agree that you will not, nor advocate, encourage, request, or assist any third party to:

🚫 Violate the Law

  • Breach or circumvent any local, state, or federal laws, regulations, court orders, or government mandates, including airport rules, tax laws, registration requirements, or any third-party rights.

🚫 Submit False or Misleading Information

  • Provide false, inaccurate, misleading, defamatory, or libelous content.

  • Submit false details regarding your name, date of birth, driver’s license, insurance, payment method, or other personal information.

  • Falsely impersonate another person or entity, or misrepresent your affiliation.

🚫 Infringe Intellectual Property

  • Infringe, reproduce, display, distribute, reverse-engineer, or create derivative works from content owned by or licensed to VYBZ, or any proprietary content found on the Services, without prior written consent.

🚫 Harm the VYBZ Brand

  • Use VYBZ trademarks, branding, or likeness in domain names, handles, or branding materials without permission.

  • Imitate or dilute VYBZ's visual identity in a way that confuses or misleads others.

🚫 Circumvent Our Platform

  • Use the Services to locate a vehicle or booking opportunity, and then complete a transaction outside the platform (gray market transactions).

  • Attempt to transfer your VYBZ account or user ID without prior consent.

  • Attempt to use VYBZ vehicles without booking through official channels.

🚫 Breach Rental Commitments

  • Fail to pay owed fees, penalties, or other charges.

  • Fail to return a vehicle on time or in the condition it was delivered, without valid cause.

  • Leave a vehicle unlocked, running, or unattended with keys inside (unless specifically instructed by VYBZ).

🚫 Harm Others or Violate Privacy

  • Harass, stalk, defame, or threaten any other VYBZ user.

  • Discriminate based on identity, appearance, orientation, origin, or belief.

  • Collect or share private information, such as photographs, payment methods, or contact info, without consent.

🚫 Misuse the Platform

  • Contact VYBZ for reasons unrelated to a booking or service inquiry.

  • Use the Services for unsolicited promotions, spam, or unrelated commercial activities.

  • Recruit or solicit users to competing platforms or services.

  • Use the Services to harvest user data or conduct background checks without consent.

🚫 Disrupt, Hack, or Tamper with the Services

  • Interfere with site function, infrastructure, or listings.

  • Deploy harmful code, bots, pings, denial-of-service attacks, spoofing, or anything intended to disrupt or exploit VYBZ systems.

  • Access or tamper with non-public areas of the Services or backend systems.

  • Bypass security measures or robot exclusion headers.

  • Reverse-engineer, decompile, or attempt to decipher any software associated with the Services.

🚫 Evade Enforcement

  • Attempt to circumvent a ban, suspension, or terminated account by creating a new account or acting on behalf of a banned user.

📜 Other Legal Matters

🚨 Violations

VYBZ has the right, but not the obligation, to investigate, pursue, and take legal action or refer matters to law enforcement regarding violations of the Agreement to the fullest extent permissible by law.

VYBZ may, at any time and without prior notice, in accordance with applicable law, remove or restrict access to any content it deems objectionable, in violation of these Terms, or harmful to the Services or the community. If we believe that you are abusing the VYBZ platform, its vehicles, or violating the letter or spirit of these Terms, we may, at our sole discretion and without limiting other remedies:

  • Limit, suspend, or terminate your VYBZ account and access to the Services

  • Deny any damage or protection claim

  • Reduce or eliminate promotional offers

  • Take technical or legal action to prevent further misuse

Additionally, we reserve the right to refuse service or terminate access to the Services to anyone for any reason, to the full extent permitted by applicable law.

✅ Policy Enforcement

When reviewing an issue, we may consider user history and the circumstances involved. At our sole discretion, we may choose to be more lenient in enforcing policies if it supports a fair resolution.

📞 Communications

We may contact you by phone or text for reasons related to your account, activity, trip confirmation, fraud prevention, unpaid invoices, or urgent messages. These communications are not for marketing purposes.

Your number may be shared with service providers working with VYBZ to fulfill these tasks. We will not share your number with third parties for their independent use without your consent. Standard messaging and data rates may apply.

You agree that VYBZ may contact you at any time in connection with these matters. You also authorize us and our service providers to monitor or record calls or web chats for quality assurance, training, or support purposes.

If you do not wish for a conversation to be recorded, you may contact us in writing at V.Y.B.Z@outlook.com. If you do not wish to have chat interactions monitored, please do not use the chat feature.

🚗 Insurance & Protection Plans

VYBZ is not an insurance company, but does provide limited insurance and protection plans for guests who book directly through the platform. All coverage is subject to the terms outlined below.

👤 Guest Commitments

As a guest, you agree to:

  • Be a legally licensed driver and provide valid proof of license.

  • Treat the vehicle and any included Extras with care.

  • Return the vehicle and any Extras on time and in the same condition they were received.

  • Not allow anyone other than an Approved Driver to operate the vehicle.

🔒 No Right of Withdrawal

For guests residing in the EEA or UK: there is no statutory right of withdrawal, as car rental is considered a date-specific service. Your only cancellation rights are those stated in our policy. However, guests may update their protection plan prior to the trip start.

💥 Guest Financial Responsibility

The primary guest is financially responsible for:

  • All physical damage to or theft of the vehicle during the trip

  • Any related costs such as loss of use, towing, and repair fees

  • This responsibility applies regardless of fault, and even if the guest has their own insurance.

Guests may limit their out-of-pocket liability by selecting a VYBZ protection plan, which only applies if:

  1. The primary guest and any Approved Driver follow all Terms, and

  2. The damage is physical (not mechanical or interior)

Protection plan coverage does not apply to:

  • Interior damage

  • Mechanical issues caused by misuse or negligence

🛡️ Liability Coverage

If you have a personal auto policy, it will apply first. VYBZ protection plans may provide secondary or excess coverage, depending on jurisdiction and the nature of the trip. If the vehicle is used for commercial or professional purposes, this may affect how coverage applies.

🚗 Use of the Vehicle

When you book a vehicle through the VYBZ platform ("Services"), you must use the vehicle only for personal or professional purposes—not for any commercial activity that would require a commercial driver’s license—unless you receive express written permission from VYBZ in advance.

You may not access the vehicle until the designated trip start time, and you must return it on time and to the exact location it was picked up from, unless otherwise approved by VYBZ. You must present a valid, current driver’s license at or before the time of vehicle handoff.

You are expected to exercise reasonable care in your use of the vehicle. You must operate the vehicle safely, and in full compliance with all traffic laws, including but not limited to speed limits and restrictions on impaired or distracted driving.

If VYBZ has any concern about your operation of the vehicle, we may terminate your trip at any time and recover the vehicle. All occupants must wear seat belts, and any child passengers must be properly secured in accordance with local laws.

You must not:

  • Leave the vehicle unlocked or unattended with the keys inside

  • Engage in prohibited or reckless driving behavior

  • Operate the vehicle outside the scope of these Terms

If you misuse the vehicle in any way, you will be fully financially responsible for any related claims, losses, or damage, and any protection plan coverage may be voided. Violations may also reduce any liability coverage to legal minimums or cancel all coverage entirely.

📡 Telematics Notice and Release

VYBZ vehicles may contain onboard devices that monitor real-time vehicle data ("Vehicle Data"). This may include, but is not limited to:

  • Vehicle condition and diagnostics

  • Damage or collision events

  • Speed, acceleration, braking, mileage

  • Location, fuel level, tire pressure, and other system metrics

By renting a vehicle, you authorize VYBZ to access and use this data. This data may be used to support maintenance, claim verification, or safety investigations. You must inform all passengers that such tracking may be in use.

You agree to indemnify and hold harmless VYBZ, its service providers, and affiliated technology partners from any damages resulting from failure of these systems or the data they provide.

✅ Condition of the Vehicle and Extras

All vehicles and optional extras are owned and maintained by VYBZ. We are solely responsible for ensuring vehicles are roadworthy, legally registered, insured, and compliant with all safety and recall requirements.

You must complete a visual inspection of the vehicle before driving. If you notice any damage or issues, please upload photos immediately and email V.Y.B.Z@outlook.com. If you do not report visible damage at the start of your rental, VYBZ may assume any unreported damage occurred during your trip.

If you believe the vehicle is unsafe, do not drive it. Contact us immediately for instructions.

👜 Lost Items Disclaimer

VYBZ is not responsible for any lost or stolen property left inside the vehicle during or after your trip. Please check the vehicle thoroughly before return.

📋 Incident Reporting

If any damage occurs during your rental, or if you're involved in an accident, you must:

  1. Immediately contact VYBZ at V.Y.B.Z@outlook.com

  2. File a police report if the incident involves a collision or criminal activity

  3. Cooperate fully with VYBZ, third-party administrators, or insurers in providing a detailed written statement, photos, and identifying information of any parties involved

If damage is more than minor (e.g., not a small scratch), you may not continue to operate the vehicle without express permission from VYBZ. Failure to report incidents or cooperate may void your protection plan.

🚓 Vehicle Theft

The vehicle may be reported as stolen to law enforcement under the following conditions:

  • Failure to return the vehicle by the agreed end time and location

  • Unauthorized return location or unapproved late return

  • Misrepresentation of facts during the rental

  • Vehicle left running, unlocked, or unattended with keys

  • Refusal to communicate with VYBZ or law enforcement

  • Providing false identification or license details

You, the primary renter, are responsible for any investigation costs VYBZ incurs to recover the vehicle. A $500 administrative fee will be charged if the vehicle must be reported stolen.

🚚 Repossession

VYBZ, or an agent on our behalf, may repossess the vehicle at your expense under the following circumstances:

  • If the vehicle is not returned on time

  • If the vehicle is abandoned, illegally parked, or misused

  • If you are found in breach of any part of these Terms

🔐 Missing Vehicles

If a vehicle booked through the VYBZ Services goes missing or is suspected to be stolen during the reservation (or an extension period), you must:

  • Immediately notify VYBZ by emailing V.Y.B.Z@outlook.com

  • Return the original ignition key to VYBZ if in your possession

  • File a police report within 12 hours of discovering the vehicle is missing

  • Cooperate fully with VYBZ, law enforcement, and any investigators or insurers involved

Failure to comply may result in the loss of protection plan coverage and may subject you to legal action.

⚖️ Dispute Resolution (U.S.-Based Guests)

PLEASE READ THIS SECTION CAREFULLY.
It contains a mandatory arbitration agreement that affects your legal rights and governs how disputes between you and VYBZ are handled.

Pre-Arbitration Resolution

Before initiating arbitration, both you and VYBZ agree to attempt to resolve the issue informally.

Governing Law

This Agreement to Arbitrate is governed by the Federal Arbitration Act, and if applicable, the laws of the State of Arizona, without regard to conflict of law provisions.

Agreement to Arbitrate

You and VYBZ agree that any and all disputes, claims, or controversies between you and VYBZ (including our employees, officers, service providers, and affiliates) will be resolved through binding arbitration.

This includes claims related to:

  • Use of the Services

  • Bookings or transactions on VYBZ

  • These Terms or any version of the Agreement

  • Any product, policy, protection plan, or vehicle provided through the Services

Claims may be based in contract, tort, statute, regulation, fraud, misrepresentation, or any legal or equitable theory — and are subject to arbitration regardless of when they arose.

This arbitration clause is intended to apply as broadly as the law allows, and the arbitrator will decide any questions about its enforceability.

Exceptions to Arbitration

The following exceptions apply:

  • Claims that qualify for small claims court

  • Requests for injunctive or equitable relief regarding copyrights, trademarks, or intellectual property

  • Claims that cannot be arbitrated by law or public policy

  • Requests for public injunctive relief under California law (if applicable)

Any court proceedings initiated under these exceptions will be stayed pending the resolution of any arbitrable issues.

Arbitration Procedures

  • Administered by FairClaims under their then-effective rules

  • If FairClaims is unavailable, arbitration will be conducted by the AAA (American Arbitration Association)

  • Claims under $25,000 may be decided by written submission or video/phone hearing

  • Claims $25,001+ may include limited discovery

  • Hearings (if needed) will be held virtually or in the county where you reside, or as mutually agreed

The arbitrator will follow applicable law, including privileges and equitable principles. The decision will be final and binding, and enforceable in any court with jurisdiction.

Confidentiality:
All arbitration communications, evidence, and outcomes will remain confidential, except as necessary to enforce or implement the ruling.

⚖️ Arbitration & Dispute Resolution

💰 Costs of Arbitration

If you initiate arbitration proceedings:

  • For claims $25,000 or less (excluding legal fees), you will pay an initial filing fee, capped at $375, and VYBZ will cover all additional arbitration costs.

  • For claims over $25,000, you and VYBZ will each pay your own arbitration fees in accordance with the applicable rules, unless otherwise provided in these Terms.

✂️ Severability

If any provision of the Agreement to Arbitrate (except for the class action waiver) is found to be invalid or unenforceable, the remaining provisions will still apply.

However, if the Prohibition of Class and Representative Actions (below) is found invalid, the entire Agreement to Arbitrate becomes void, and the remainder of the Terms and dispute resolution clause will continue to apply.

❌ Right to Opt Out of Arbitration

If you are a new VYBZ user, you may opt out of this arbitration agreement by sending an email to V.Y.B.Z@outlook.com within 30 days of accepting these Terms or before the start of your first rental — whichever comes first.

Your opt-out email must include:

  • Full name

  • Mailing address (street, city, state, zip/postal code)

  • Email address associated with your VYBZ account

This is the only valid way to opt out. If you opt out, all other sections of these Terms (including dispute venue) still apply. Once you submit a valid opt-out notice, it applies to all future versions of these Terms — no need to send again.

🔁 Future Amendments to Arbitration Agreement

If VYBZ updates this Agreement to Arbitrate, the change will not apply to any claims you have already filed. If you disagree with future changes, you may close your account within 30 days to avoid being bound by them. Any claims after that would be governed by the last version of this agreement you accepted.

🏛 Judicial Forum (When Arbitration Doesn’t Apply)

If arbitration doesn’t apply (due to opt-out, legal exemption, or court decision), all legal claims must be brought in:

  • A state court in Maricopa County, Phoenix, Arizona, or

  • A U.S. District Court for the District of Arizona

You and VYBZ agree to submit to the personal jurisdiction of these courts, and that the laws of the State of Arizona will govern the dispute (except where California law must apply for California residents in consumer arbitration).

🚫 Prohibition of Class & Representative Actions

All legal disputes must be resolved individually. You may not:

  • File a class action or represent others in arbitration or court

  • Consolidate your claim with anyone else’s

  • Seek non-individualized relief (injunctive, declaratory, or monetary)

Exception: A public injunctive relief claim under California law may be brought in court only if such a claim cannot be arbitrated by law.

🛠 Arbitration Option

If you are located outside the United States and a dispute arises between you and VYBZ, we encourage you to first seek resolution directly by contacting us at V.Y.B.Z@outlook.com. If informal efforts do not resolve the issue, we may mutually agree to pursue arbitration or another neutral alternative dispute resolution process, where permitted by law.

🌐 Google Terms

Some areas of the VYBZ Services integrate Google Maps/Places API, including Google reCAPTCHA Enterprise, which is used to prevent spam and abuse.
By using the Services, you agree to be bound by Google’s Terms of Service.

🔚 General Provisions

🚫 Termination

You may stop using the Services at any time. VYBZ may terminate your access or remove listings at its discretion, with or without cause.

Termination does not release you from obligations incurred prior to the termination, including:

  • Rental or damage fees

  • Liability terms

  • Use of submitted content (e.g., uploaded images)

All disclaimers, waivers, indemnity clauses, and dispute provisions will survive termination.

🚫 No Vehicle Transfer or Assignment

Except as otherwise provided herein, nothing in these Terms constitutes an actual or purported transfer or assignment of any right or interest in a vehicle or optional extras provided through the VYBZ Services. All vehicles and optional extras remain the sole property of VYBZ.

📄 Disclaimers

VYBZ provides a platform that enables users to reserve and drive vehicles and optional extras owned and operated exclusively by VYBZ.

Unless otherwise stated in these Terms, VYBZ does not provide third-party vehicle sharing services, nor does it act as a broker for other vehicle owners. All vehicles listed are owned and maintained by VYBZ.

The Services are provided “as is,” without warranties of any kind—either express or implied. To the fullest extent allowed by law, VYBZ disclaims all warranties, including:

  • Merchantability

  • Fitness for a particular purpose

  • Quiet enjoyment

  • Non-infringement

  • Any implied warranties arising from prior course of dealing or trade usage

VYBZ makes no guarantee that the Services, listings, vehicles, or optional extras will meet your expectations or be available without interruption, error, or defect.

No oral or written information obtained from VYBZ or any of its representatives will create a warranty unless expressly made in these Terms.

⚠️ Limitation of Liability and Waiver

To the fullest extent allowed by law, you waive all rights to sue or make claims against VYBZ, its employees, directors, officers, service partners, or insurance providers (collectively, the “VYBZ Parties”) for any damages or losses, including but not limited to those arising from:

  1. Vehicle availability or return issues

  2. Mechanical problems or vehicle malfunctions

  3. Manufacturer defects or warranty disputes

  4. Legal or registration issues related to a vehicle

  5. Third-party vehicle valuations

  6. Any delays, cancellations, or user misconduct

VYBZ shall not be liable for any incidental, special, exemplary, or consequential damages, including:

  • Lost profits

  • Loss of data

  • Service disruptions

  • System failures

  • Costs of substitute transportation or services

Unless otherwise required by law, VYBZ’s total liability will not exceed:

  • The total amount you paid to VYBZ in the 12 months prior to the event giving rise to the claim

  • Or $100—whichever is greater

You also waive any rights to sue or make claims against other VYBZ users for losses or damages arising from your use of the Services.

California Users: You waive California Civil Code §1542, which states:

“A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release…”

These waivers and limitations are essential terms of your agreement with VYBZ and apply to the extent permitted by law. If any portion is deemed unenforceable, the remainder will still apply.

🛡 Indemnification

You agree to defend, indemnify, and hold harmless VYBZ and its officers, directors, employees, and affiliates from any claims, losses, damages, or legal costs arising from:

  1. Your use of the Services

  2. Violation of these Terms

  3. Any content you submit

  4. Your interaction with other users

  5. Your booking or use of a vehicle or optional extra

This includes all types of damages, whether direct or indirect, and whether or not resulting from negligence or breach.

This indemnification clause is a fundamental part of the agreement between you and VYBZ and remains valid even if other provisions are deemed unenforceable.

💵 Liquidated Damages

You acknowledge that the actual damages likely to result from the following breaches are difficult to estimate and would be difficult for VYBZ to prove with certainty. Therefore, you agree to pay $5,500 per breach as liquidated damages if you engage in any of the following conduct:

  1. Participating in gray market transactions that circumvent VYBZ’s platform or fee structure

  2. Using VYBZ’s domains, trademarks, or taglines without express written consent — including registering domain names or social handles, or bidding on paid ads

  3. Suing or asserting legal claims against VYBZ or any VYBZ-affiliated party in a manner prohibited or waived by these Terms

  4. Circumventing VYBZ account restrictions or policies by creating new accounts after termination or suspension

This amount is a reasonable estimate of potential loss and not a penalty. It is a material term of your agreement with VYBZ and shall apply to the extent permitted by law. If any portion is found unenforceable, the rest will remain in effect.

🚫 VYBZ is Not a Rental Car Company or Leasing Provider

VYBZ is not a traditional rental car company. While it owns and operates all vehicles listed on the platform, it does not offer short-term or long-term leasing to the public.

VYBZ provides a digital platform that allows individuals to book exclusive VYBZ-owned exotic vehicles under clearly defined terms. No third-party vehicle listings or external hosts are involved.

💱 Rounding and Currency

VYBZ may round payments up or down to the nearest whole unit of currency (e.g., nearest dollar, euro, or pound), unless prohibited by applicable law.

Currency displays on the platform are based on your search location or the location of the vehicle you’re booking.

🌐 Translations

Where a non-English version of these Terms has been provided, the English version will govern in the case of any conflict or ambiguity. In France, and for consumers residing in France, the French version will prevail.

⚖️ Severability and Non-Waiver

If any provision in these Terms is found unenforceable, the rest remain valid and enforceable.

The failure of VYBZ to enforce any part of these Terms will not be considered a waiver of its rights. A waiver in one instance does not apply to any other or future instance.

🧾 General Legal Terms

  • You are not an employee, agent, or legal representative of VYBZ.

  • You may not make commitments on VYBZ’s behalf.

  • The Terms are the entire agreement between you and VYBZ, and override any prior written or verbal agreements.

  • You may not assign your rights or delegate obligations under this Agreement without VYBZ’s written consent.

  • Modifications must be signed by a VYBZ director or officer to be valid.

🕒 2. What if I’m running late to return the vehicle?
If you're going to be late, notify us immediately by email.
Late return fees are as follows:

  • $75 for the first hour

  • $150 for each additional hour

  • After 4 hours, a full-day rental fee of $999 will be charged
    Late returns may also affect future booking eligibility.

🛑 3. What if I get pulled over or receive a citation?
Remain calm and follow all instructions from law enforcement.
You are responsible for any citations, tickets, tolls, or violations incurred during your rental period. Notify VYBZ of any incident immediately.

⛽️ 4. Do I need to return the car with a full tank?
Yes. The vehicle must be returned with the same fuel level as at pickup.
If not, a refueling fee of $8 per gallon will apply.

🧼 5. Does the car need to be cleaned before return?
Yes. Vehicles must be returned in clean condition.

  • Minimum cleaning fee: $200

  • Excessive interior mess, odor, or damage may result in additional professional cleaning charges.

  • No smoking or pets are allowed in the vehicle.

🛠️ 6. What do I do if there’s a mechanical issue or warning light?
Pull over to a safe location and email us immediately at V.Y.B.Z@outlook.com.
Do not attempt to repair the vehicle on your own under any circumstance.

🧾 7. What if the vehicle is damaged or involved in an accident?
Take clear photos, gather information from all involved parties, and notify VYBZ immediately.
For serious incidents, a police report may be required.
Failure to report damage may result in loss of coverage and financial liability.

🚭 8. Can I smoke or vape in the vehicle?
No. Smoking, vaping, or creating strong odors inside the vehicle is strictly prohibited.
Violations will incur a cleaning and deodorizing fee of up to $500.

🛣 9. Are there mileage limits or travel restrictions?
Yes.

  • Each rental includes a 100-mile daily limit

  • Every mile beyond the limit will be billed at $3 per mile

  • The vehicle may not leave the state of Florida without prior written approval from VYBZ

🧍‍♂️ 10. Can someone else drive the vehicle?
No. Only the Renter listed in the booking may operate the vehicle, unless prior written authorization has been granted by VYBZ.
Unauthorized drivers will void protection and may result in full financial liability.

⚠️ 11. Are there prohibited driving behaviors?
Yes. The following actions are strictly prohibited:

  • Disabling traction control

  • Racing, drifting, or aggressive driving

  • Off-roading, towing, or using the vehicle for any unlawful activity
    Any of these violations may void coverage and result in full liability.

📍 12. Where do I return the vehicle?
The vehicle must be returned to the same location from which it was picked up, unless VYBZ has provided prior written approval for a different return point.
Failure to do so may result in additional fees and may affect your eligibility for future rentals.
